Sections of the Kenya Anti Counterfeiting Act Struck Down as a Threat to Fundamental Human Rights

Musungu – In a landmark Judgement that has been hailed by many in the health community, including UNAIDS, the High Court of Kenya (Honourable Lady Justice Mumbi Ngugi – hereinafter “Justice Ngugi or “ the Judge”) held, in the case of Patricia Asero Ochieng and 2 Others v. the Attorney General & Another, that three sections of the Kenya Anti-Counterfeit Act, 2008 were unconstitutional being a threat to the right to life, dignity and health. Noting that: “There can be no room for ambiguity where the right to health and life of the petitioners and the many other Kenyans who are affected by HIV/AIDS are at stake”, the Judge specifically found that Section 2 (definition of counterfeiting), section 32 (offenses) and Section 34 (Powers of the Commissioner to seize suspected counterfeit Goods) could severely limit or threaten access to affordable and essential drugs including generic medicines for HIV/AIDS and therefore infringed the right to life, dignity and health of the three Petitioners (all people living with HIV/AIDS) under the Constitution of Kenya, 2010.

Intellectual Property and Open Development in Africa – Fellowship Opportunity

Sisule F. Musungu – Open African Innovation Research and Training (Open A.I.R) Project has invited applications for a Fellowship in Cape Town. The Fellowship for three  or six months will see the selected fellow work on the project’s research, outreach and training activities. The Project will provide the Fellow with subsistence and research stipend of up to ZAR 65,000 for each three month period and will also cover the cost of a return ticket between the Fellow’s place of residence and Cape Town. The Fellowship is Open to African intellectual property and innovation researchers and scholars.

WTO 8th Ministerial Conference to Take Place in Geneva (15 -17 Dec 2011)

IQsensato – The Eighth World Trade Organization(WTO) Ministerial Conference is slated to take place at the Geneva International Conference Centre from the 15th to 17th December 2011. No breakthroughs or deals are expected at the Conference on the Doha Round of Trade Negotiations as such. The trade ministers in addition to adopting some basic Decisions will essentially come together to discuss three broad topics, namely the “Importance of the Multilateral Trading System and the WTO”, “Trade and Development” and “Doha Development Agenda.” The accessions of Russia, Samoa and Montenegro will also be finalised at the meeting. With these three countries joining the organization WTO membership will rise to 156.

Discussion Forum for the World Trade Report 2012

Sisule F. Musungu – The World Trade Organization (WTO) has launched a discussion forum for the 2012 World Trade Report. The 2012 Report will focus on”Looking beyond international cooperation on tariffs”. The aim of the discussion forum is to encourage debate on the topic of the Report and researchers, policy-makers and others interested in the topic are invited to submit short articles (of no more than 1,000 words) on the topic and/or to submit views on the articles submitted by others. WTO Secretariat staff Marc Bacchetta and Cosimo Beverelli  have done a short paper providing background to the Report’s theme. The topic for the 2011 Report was “The WTO and preferential trade agreements: from co-existence to coherence”.
